REQUESTING OF THE DOCUMENTS
FROM ABROAD
Directorate
of Consular Service requests the documents from abroad through
the foreign diplomatic missions and consular posts of Ukraine.
Civil documents can be requested basing on the applications
of citizens residing in the territory of Ukraine.
The rules
of requesting the documents provide the application form to
be filled in which are sent to applicants on their written
address to the Directorate of Consular Service.
THE
APPLICATION FORM
A consular
fee should be raised accordingly to the consular tariffs shall
be paid (in July 2001 the consular fee for requesting the
documents was 8 UHR for Ukrainian citizens and 17 UHR for
foreign citizens and non-citizens). A consular fee should
be sent to the address: UDK in Kyiv, account 31116180100014,
Code of payment 2426621, MFO 820019.
In case
of absence of corresponding data in the archives, the consular
fee already paid for requesting should not be reimbursed.
REQUESTING
OF THE DOCUMENTS, WHICH ARE NOT WITHIN THE COMPETENCE OF THE
DIRECTORATE OF CONSULAR SERVICE
All questions
concerning an additional sum, forced labour during compensations
for compulsory works during the World War II are within the
competence of the Ukrainian national fund "Vzayemorozuminnya
ta prymyrenya" ("Mutual Understanding and Appeasement").

If there is no data in archives concerning forced labour or
staying in concentration camps in Germany, you should apply
to Search Service of the National Society of Red Cross in
order to arrange the request to International Search Service.

The additional information about the procedure of obtaining
the compensation from the Federal Republic of Germany for

REQUESTING
OF THE DOCUMENTS FROM UKRAINE
In order
to request the documents from Ukraine the persons residing
abroad should apply to Diplomatic Missions and Consular Posts
of Ukraine in the receiving country in order to arrange the
necessary request to Ukraine.
The requests
for documents can be sent directly to Ukrainian Archives Bodies.
In this case Diplomatic Missions and Consular Posts of Ukraine
abroad will inform about he results of these requests.
THE
INSTRUCTION ON REQUESTING OF THE DOCUMENTS FROM UKRAINE CERTIFYING
THE REGISTRATION OF CIVIL STATE ACTS
In order
to confirm facts that are subjected to registration authorities
of civil state properly certificates references with basic
data about a person are issued by these authorities.
Secondary
(Repeated) certificates are issued to the persons, on whom
names the civil state acts are registered, and secondary birth
certificates of children can be issued only to their parents
or adopters. The secondary birth certificates for children
under 18 years of old, can be issued to their guardians, and
administration of child houses, where the children are being
brought up. Persons 16 years of age can be given the secondary
certificates upon their passport.
The person deprived of parents' rights can not be given secondary
birth certificates of children. On issuing a secondary birth
certificate the data about the parents are given in full accordance
with the registration data of the birth act.
The secondary
death certificates can be issued only to relatives of the
deceased (children, including adopted ones, spouses, brothers
and sisters, grandparents of deceased).
Family
relations should be confirmed by official documents.
The secondary
certificates of marriage which has been terminated can not
be issued. In this case the special certifying paper is issued
upon the request of applicants.
The papers certifying the registration of the civil state
acts are issued to the persons on whom a corresponding act
is registered. Besides, the papers certifying birth, marriage,
divorce, changes of a family name, a given name, patronymic
name of the acts of the civil state are given to relatives
on direct upgoing and downgoing lines as to as adopters and
guardians.
In application for issuing secondary certificate should be
noted: family name, given name, middle name and address of
applicant; family name, given name and middle name of the
person, for whom name the certificate is requested; type of
requested certificate; when and by which organ of registration
of civil state act has been registered; aim of request of
the secondary certificate is requested.
If the birth certificate is requested full names of the parents
should be indicated. If the marriage or divorce certificate
is requested the name of the spouse should be indicated.
INSTRUCTION
FOR THE LEGALIZATION OF DOCUMENTS BY THE MINISTRY OF FOREIGN
AFFAIRS OF UKRAINE (dated the August 2001)
The Directorate
of Consular Service of the Ministry of Foreign Affairs of
Ukraine pursuant to the Vienna Convention on Diplomatic Relations
(1963), the Consular Statute of Ukraine, approved by Decree
of the President of Ukraine 127/94, conducts legalization
of documents issued by official bodies of Ukraine directed
for circulation abroad. Since Ukraine is not a Party to the
Hague Convention abolishing the Requirement of Legalization
for Foreign Public Documents, the chain legalization procedure
is in use on the territory of Ukraine.
The Directorate of Consular Service legalizes the following
documents:
original public documents of new Ukrainian sample, issued
by authorities registering acts of civil state, certified
by regional Department of the Ministry of Justice in the region
(oblast') of their issuance; Department of Justice in the
Autonomous Republic of the Crimea; Municipal Departments of
Justice in Kyiv and Sevastopol; Cetral and Livoberezhnyi Authorities
registering acts of civil state.

degree etc.) of international sample shall be legalized if
the application letter of the Higher Educational Institution
issuing such document is provided. This letter should be certified
by the Ministry supervising such Institution.
copies, translations and other documents, certified or issued
by State notaries. These documents should be certified by
the Ministry of Justice of Ukraine.
Upon legalization by the Directorate of Consular Service,
public documents should be certified by diplomatic mission
or consular post of the State wherein they will be used.
The Directorate of Consular Service shall not legalize documents,
executed in a foreign State. Such documents should be legalized
by Ukrainian Consular Post in a State from which such documents
emanate. In case there is no Ukrainian Consulate in such a
State, foreign documents could be legalized by the Directorate
of Consular Service of the Ministry of Foreign Affairs of
Ukraine after being certified by the Ministry of Foreign Affairs
of the State (or other body authorized to certify the documents
designated for use abroad) from which they emanate and by
a Consular Post of such State, representing this State in
Ukraine.
Documents belonging to natural persons (citizens) shall be
accepted for legalization only if a passport or any other
document identifying person is provided; as far as the legalization
of documents certifying marital status is concerned, a national
passport is required. When handing in documents for legalization
belonging to or written out for another person, an applicant
should present notaries letter of attorney issued by the owner
of these documents. A letter of attorney, issued by competent
bodies of foreign State should be certified in Ukrainian Consulate
in this State.
Documents of legal entities shall be accepted if the application
letter on a blank with a requisite and a seal of the enterprise.
Such application letter must contain: a list of documents,
purpose for legalization of documents, information about a
person authorized to hand in documents. Where necessary the
Directorate of Consular Service may require other (additional)
documents to ascertain the facts indicated in documents subject
to legalization.
All citizens handing in their documents for consular legalization
shall fill in an application form.
Consular fees for legalization shall be paid directly in the
bank office located in the Ministry of Foreign Affairs, upon
documents subjects to legalization have been handed in:
8 Hrn for documents of citizens of Ukraine;
85 Hrn for documents of legal entities and organizations related
to their activity;
17 Hrn for documents of non-citizens of Ukraine.
Legalization procedure takes 1 day an Documents, having been
accepted for legalization, can be collected starting from
the next day. Documents legalized on urgent procedure can
be collected the same day. In this case the double consular
tariff is to be paid.

Consulting concerning legalization could be provided by officers
of the Directorate of Consular Service of the Ministry of
Foreign Affairs in the rooms 2, 3. The Directorate of Consular
Service of the Ministry of Foreign Affairs is not responsible
for the validity of any information received from other sources.
The rules stated in this Instruction may be subject to change.
The rules of consular legalization in foreign Consular Posts
based in Ukraine may be obtained only in these Consular Posts.
Unfortunately, the Directorate of Consular Service due to
limited technical capabilities does not conduct the correspondence
via Internet.

inheritance accordingly the legislation of Ukraine:
